Employees may be the last ones to see their rights preserved - or maybe never at all

Two years after shutting down operations due to a crisis, Jet Airways fears the rebirth of the Jalan-Kalrock consortium

“The Consortium maintains its position that it wants to work alongside the Ministry of Civil Aviation, the General Directorate of Civil Aviation (DGCA) and all of its competitors to put Jet Airways back in the skies,” said the Jalan-Kalrock consortium to press demo.

Jet Airways personnel express concerns about unpaid wages and retirement benefits, and have filed a petition on the matter with the Corporate Law Appeal Court (NCLAT), the Press Trust of India reported.

The Jet Airways Cabin Crew Association (JACCA) and the land workers union Bhartiya Kamgar Sena argued to the court that money owed to employees was not included as part of insolvency proceedings under the Corporate Insolvency Resolution Process (CIRP) .

However, a petition signed by the unions explained that the consortium's plan includes the spin-off of the Jet Airways subsidiary, Airjet Ground Services Ltd (AGSL) and that employees who were on the payroll at the date of approval of the plan will be transferred to this entity segregated.

Once that happens, Jet Airways “will not be responsible for all the retirement benefits of the split employees, and AGSL, which is not yet operational, will be the only one to have that responsibility,” he said. Jet Airways cabin and ground crew have not been paid since March 2019.

The petition also denounced the consortium's alleged requirement that if fewer than 95% of Jet Airways employees voted in favor of the resuscitation plan during a vote that began on July 5, the consortium would have the right to liquidate AGSL.

Finally, the consortium says that more than 3500 employees were associated with Jet Airways, so now the company plans to take on just a few hundred of them back.
