Draft Legislative Decree will regulate international aviation on Brazilian soil

With the Draft Legislative Decree 256/21, the Brazilian government validates the terms of the multilateral agreement on international air services, in order to expand the basic freedoms of non-stop overflight and technical landing for refueling, repairing or sheltering aircraft in air services international regulars.

The multilateral agreement was concluded on December 7, 1944, during the Convention on International Civil Aviation, and the Chicago Convention entered into force in 1947, allowing the creation of the International Civil Aviation Organization (ICAO), which would administer the convention and exercise global governance over the aviation industry by providing safety, efficiency and economy of air services.

The text provides, for example, that each country that is part of the agreement may designate the route to be followed in its territory by any international air service and, also, may define the airports at which such services may be performed. In addition, it may also impose fees on these services for the use of airports and facilities.

Brazil, Russia, Indonesia and Chin were left out of the agreement at first.

Now the project will be analyzed by the Traffic and Transport committees; and Constitution and Justice and Citizenship. Afterwards, it will proceed to discussion and voting in the Plenary.
