Itapemirim does not send data on affected passengers to ANAC and denies passenger re-accommodation

After the “temporary” stoppage of Itapemirim Transportes Aéreos (ITA), the National Civil Aviation Agency (ANAC), last night (19), issued a notice of violation against the ITA. The company did not send the requested data on flights and passengers affected by the suspension of its flights to the agency.
ANAC urgently requested the list of canceled flights, which extended throughout the country, as well as the list of affected passengers and passengers assisted through re-accommodation, execution of service by another mode of transport, flight rescheduling, reimbursement full amount of the ticket or credit for future use.
ANAC also requested a company action plan for affected consumers. As ITA had until 6 pm yesterday to present the requested data and did not do so, ANAC concluded that "it was found that the company refused to provide information about its services requested by an inspection agent". Thus, the value of the fine must be 35 thousand reais.
In addition, ITA is unlikely to re-accommodate affected passengers on other airlines' flights. The company informed in a note that it will seek re-accommodation only for clients who are away from home and who have previously traveled with ITA.
Thus, other passengers should only be entitled to a refund. It is important to point out that this measure is also in breach of ANAC 400, which concerns the cancellation of flights. In this case, the company must offer alternatives for re-accommodation, reimbursement or other means of transport, at the passenger's choice.
ITA directs affected passengers to send an email to falecomaita@voeita.com.br. However, there are reports of customers saying that this service channel does not work.
The case could even get worse for the company, since the affected passengers can sue the airline in court asking for compensation and, eventually, compensation for moral and/or material damages, if they have lost a travel package or some important event.
