Itapemirim is fined almost half a million reais by Procon in Rio de Janeiro

Itapemirim received yesterday (29) a fine of 468 thousand reais by the Procon of the State of Rio de Janeiro after canceling all its flights in December 2021, in breach of ANAC (National Civil Aviation Agency) rules.
ANAC establishes (Resolution No. 400/16) that the company must offer re-accommodation, full refund or other mode of transport, which is the consumer's choice, in the event of flight cancellation. However, Itapemirim did not prove that it had done so.
After an investigation, Procon do Rio found “abusive practice, failure to provide service and the duty to provide information”, in addition to non-compliance with consumer laws. The agency also claims that it was not answered in its inquiries.
“Canceling flights abruptly, and even during the holiday season, generated frustration and brought inconvenience to hundreds of consumers in Rio de Janeiro. Not providing information, nor offering the passenger the option to choose between re-accommodation, reimbursement or execution of the service by another modality is unacceptable”, declared the president of Procon-RJ, Cássio Coelho.
Since the beginning of its operations, Itapemirim has been involved in controversies, such as delays, flight cancellations and lack of payment to employees and suppliers.
